1. Scope of this Policy
This Refund Policy applies to payments made for SeaLifeHits memberships, traffic credits, advertising, upgrades and other paid digital services supplied directly by SeaLifeHits.
Where a third-party payment provider is used, that provider's payment rules may also apply. Nothing in a third-party provider's terms or in this policy overrides rights that cannot legally be waived.
2. Mandatory Consumer Rights
SeaLifeHits is currently administered and operated from Norway. Consumers may have statutory rights under Norwegian, EEA or other applicable consumer law depending on the transaction and the consumer's location.
For distance contracts concluded online, consumers who are legally entitled to a withdrawal period will receive that right in accordance with applicable law. Under Norwegian rules, the general withdrawal period for a service contract is 14 days from the date the agreement is entered into.
If a consumer expressly asks for a paid service to begin before the withdrawal period has expired, applicable law may allow payment for the proportion of the service already supplied. Where the legal requirements for loss of a withdrawal right are met after full performance, that right may end.
3. When a Refund or Adjustment May Be Appropriate
SeaLifeHits will review refund or account-adjustment requests in good faith. Examples include:
- a duplicate payment or clear billing error;
- a paid service that SeaLifeHits failed to provide;
- a material access problem caused by SeaLifeHits that cannot be corrected within a reasonable time;
- a paid digital service that is materially defective or materially different from what was promised;
- a payment that should be returned under a valid statutory withdrawal right;
- a refund, price reduction or termination remedy required by applicable law;
- another exceptional circumstance where SeaLifeHits determines that a refund or account adjustment is fair and appropriate.
Where a problem can reasonably be corrected, SeaLifeHits may first attempt to restore access, correct the account, re-credit the service or otherwise remedy the problem.
4. Situations That Do Not Automatically Create a Refund
The following situations do not automatically create a right to a discretionary refund, although mandatory legal rights still apply:
- changing your mind after any applicable withdrawal period has expired;
- forgetting to cancel a recurring membership before a renewal is processed;
- not using a membership, advertising allocation or credits that were correctly made available;
- failing to obtain traffic, referrals, sales, income or other results that were never guaranteed;
- a third-party website, offer or program promoted through SeaLifeHits failing to meet your expectations;
- account restrictions resulting from substantiated fraud, cheating, spam, malware or serious violations of the SeaLifeHits Terms & Conditions, except to the extent that applicable law requires a monetary remedy.
5. Recurring Memberships and Cancellation
Recurring memberships may currently be paid through PayPal where that option is offered. A member may cancel future recurring payments using the cancellation controls provided by the payment provider or another cancellation method SeaLifeHits makes available.
A cancellation is intended to stop future renewal. It does not automatically reverse a payment that has already been completed.
If a renewal has been processed and you believe it was incorrect, duplicated, unauthorised, or subject to a statutory right of withdrawal or another legal remedy, contact SeaLifeHits promptly and we will review it.
If cancellation or a payment-system event causes access to end earlier than a period for which you are legally entitled to service, contact us so the account and payment can be reviewed and corrected as appropriate.
6. Traffic Credits, Advertising and Commission-Balance Purchases
Traffic credits, banner impressions, text-ad impressions and similar advertising allocations are digital service units. Once correctly delivered to an account and used, served, assigned or consumed, they are normally not refundable merely because the member later changes their mind, except where applicable law requires otherwise.
If purchased credits or advertising were not delivered, were delivered incorrectly, or were affected by a verified technical billing error, SeaLifeHits may restore the units, correct the account or provide an appropriate refund.
Where SeaLifeHits allows a member to use an eligible commission balance to obtain credits or a membership upgrade, an approved correction will normally be made back to the SeaLifeHits commission/account balance rather than converted into a new cash payout, unless applicable law or the circumstances require another result.
7. Service Problems, Defects and Non-Delivery
If a paid SeaLifeHits service is unavailable, materially defective or not supplied as agreed, please contact us with enough information to identify the account, payment and problem.
SeaLifeHits may first attempt to correct the problem. Where a qualifying defect cannot be corrected as required, applicable consumer law may provide rights including a price reduction, termination of the affected agreement and repayment.
Temporary maintenance, short hosting interruptions or third-party network problems do not automatically result in a refund. A prolonged or material failure affecting a paid service will be assessed according to the circumstances and applicable law.
8. Fraud, Abuse and Refund Misuse
SeaLifeHits may investigate suspected fraud, duplicate accounts, manipulated transactions, chargeback abuse, cheating or other misuse. Evidence of abuse may be taken into account when deciding a discretionary refund or account adjustment.
However, suspected abuse does not allow SeaLifeHits to remove a mandatory legal right without a lawful basis.
9. PayPal, Chargebacks and Payment Disputes
We encourage members to contact SeaLifeHits first when there is a billing or access problem because many issues can be corrected quickly.
Contacting SeaLifeHits first is a request, not a condition that removes your rights. Nothing in this policy prevents a member from using a lawful dispute process offered by PayPal, a card issuer, a bank, a consumer authority or another competent body.
SeaLifeHits may provide accurate transaction, login, service-delivery and account records when responding to a payment dispute.
10. How Approved Refunds Are Processed
Where a refund is required by law, SeaLifeHits will follow the legally required method and deadline.
Otherwise, an approved discretionary refund will be processed as promptly as reasonably possible, normally through the original payment method where practicable. Payment providers may require additional processing time after SeaLifeHits submits the refund.
SeaLifeHits does not charge a separate fee simply for issuing a refund where such a fee would be prohibited by law. Currency-conversion differences or independent payment-provider charges outside SeaLifeHits' control may affect the final amount received where legally permitted.
11. How to Request a Refund or Payment Review
Please provide:
- your SeaLifeHits username or registered email address;
- the payment date and amount;
- the PayPal transaction ID or other available payment reference;
- a short explanation of the problem; and
- any useful screenshot or supporting information.
Do not send passwords or other authentication secrets.
12. Changes to this Refund Policy
SeaLifeHits may update this policy when reasonably necessary because of changes to the service, payment arrangements, business operations or applicable law.
Changes will not be applied in a way that removes mandatory rights that have already arisen. Where notice of a material change is required by law, appropriate notice will be provided.
